Subject: Request for Information under RTI Act, 2005 regarding implementation of OROP-3 and denial of ₹6200 X Pay to pre-01.01.2016 diploma-holding technical retirees despite AICTE equivalency and 7th CPC recommendations.

Respected Sir/Madam,

Kindly provide the following information under the RTI Act, 2005 with reference to Ministry of Defence Letter No. 1(1)/2019/D(Pen/Pol) dated 18.05.2023, wherein it is stated that recommendations of the 7th CPC are not applicable to those who retired prior to 01.01.2016, especially regarding the grant of ₹6200 X Group Pay to Group X diploma-holding personnel.

Information requested under RTI Act, 2005

1. Please provide the certified copy of file noting, decision-making authority, and policy basis for the assertion made in Para 4 of the above-mentioned letter that:

"The recommendations of the 7th CPC are not applicable to those who have already retired from service

before 01.01.2016."

2. Whether X Group Pay @ ₹6200 is classified as a new allowance or a revised enhancement of an existing allowance. Please provide documents/rules which categorize it either way.

3. Whether any order or notification exists that excludes pre-2016 diploma-holding technical veterans (approved by AICTE and granted equivalent status to Engineering Degrees per AICTE Notification dated 10.04.2003) from receiving ₹6200 X Pay under Table 8. If yes, kindly provide a certified copy.

4. Provide a copy of AICTE recognition acceptance by MoD or Services HQ for technical courses conducted by Armed Forces training institutes, and relevant file noting validating AICTE-equivalence for X Pay.

7. How can these recommendations be used to determine post-2016 retiree benefits but ignored for pre-2016 pension revision under OROP despite the OROP policy aiming at parity?

8. Whether any representation, review petition, or clarification file is under process regarding incorrect placement of diploma-holding Group X pensioners under Table 7 (₹3600) instead of Table 8 (₹6200).

If yes, provide current file status and noting.

9. Please provide the total number of such affected personnel, i.e., pre-2016 diploma-holding technical retirees, who were placed under Table 7 instead of Table 8.
